The current minimum for whiplash is around £1500. You sound like you will get a bit more than this if it is not all eaten up by the solicitors fees.

Hiya sounds like a pretty big accident. First of all for a normal whiplash your looking around at about £1000+ but from the sound of your accident your bound to get a lot more. Phone up the claim people and only take on accident claim company's that give no win no fee promise. Most of these companies don't take cut off your compensation either as they get paid from 3rd party. Your entitled to that compensation, its not like your claiming a fraud or anything. So don't feel guilty. Oh you should also talk to car insurance company too, they would either replace / repair / or pay off your car depending on the damage.

You can sue for loss of earnings, pain and suffering from the driver that hit you.
I depends how long you are going to be of work and how long it is going to take before you are fit and well.
Ja.

Can you prove that the accident was not caused by you jumping on the brakes without cause ?

That's what those behind might claim. You need expert advice but not from the many ambulance chasers out there.

there is no way a Doctor can tell if a person has Whiplash or not the fact is you hit the back of their car and they are going to screw your insurance for it with the help of their insurance.
at the end of the day your insurance will pay out coz its not worth there while going to court to argue over what will be about £4000-£6000
i know this coz the same thing happened to me but in my case i was the passenger in a friends car that was hit, there was nothing wrong with me but i got nearly £2000 i know its wrong but hell its easy money

I deal with whiplash claims all the time as I work for an insurer, and we often get one party claiming that the other party is faking an injury, but all whiplash injuries have to be certified by a doctor before the insurer will take the claim on. Sometimes the insurers own doctor will also check the person out.

Doctors have to be certain before they diagnose any kind of injury as they could lose their G.M.C. licence if they were to sign a statement saying that someone is injured when they aren't. No doctor would risk that.

Trust me. Insurance is a competitive industry and all insurers are doing their best to keep costs as low as possible. Every claim they receive is scrutinised in fine detail, and they would not pay out unless they absolutely have to. They would have plenty of supporting evidence if there was an injury, and if they were to accuse someone of faking an injury when they have such evidence, signed by doctors, the insurer could be sued, or even lose their trading licence.

As for the insurer coming to inspect your car, they do that with all accident claims, whether it be at the garage carrying out the repairs or at the home address. They are just looking for supporting evidence again, and being thorough.

The bottom line is, if she isn't injured, she wont get the evidence to support her case and wont be paid out. If she is injured, she is entitled to claim, just as you or anyone else would be if you were injured. It is up to the insurer to decide whether they pay out, and is not something that you can influence in any way, so just sit back and relax and let them deal with it.

Not sure why the police are now involved if the officer at the scene sorted it out. It should have been left to insurance companies to sort out.

There was no need for a statement at the station as they should have contacted the attending officer first. Not sure what they were playing at and certainly wouldn't worry about it as it will never go to court.

They (insurance company) will be coming to look at your car to see if there is any damage to back up the other parties claim. They will also need hospital/doctor records from the other person as well as to stand any chance of a claim they would need to see a GP within the first 48 hours.

okay... first of all, WHY is that policeman who was there at the scene not involved? i would think that the cop's judgment counts for something like that - it does for other events.
i would be angry too, but i consider it her fault too.
you said she stopped unexpectedly - so you reacted as you could.
if anything, i would think that's her fault.
but she sounds like a broad, so she probably wants whatever money she can get.
bottom line, what can she do...?
you can however have a giant smirk on your face when she fails at an attempt to get money (which i'm assuming is why she's doing that)
i'd love to have a say or two to her if i were you but that's backfired on me >:(
